West Bengal Government Hands Over Documents in Students’ Murder Case to NIA, High Court Expresses Displeasure

The West Bengal government notified the Calcutta High Court on Monday that the state’s Criminal Investigation Department (CID) has transferred all investigation documents regarding the 2018 murder of two students in North Dinajpur district to the National Investigation Agency (NIA). Tapas Burman and Rajesh Sarkar, students at Darivit High School in Raiganj, were allegedly killed in a police firing incident in September 2018.

State Chief Secretary BP Gopalika, along with State Home Secretary Nandini Chakraborty and Additional Director General of CID Dr. R Rajasekaran, appeared virtually before Justice Rajasekhar Mantha to report the handover of probe-related documents to the NIA.

Justice Mantha expressed disappointment, emphasizing that as top administrative officials, it was their obligation to comply with the court order to physically appear. On April 12, Justice Mantha initially directed the officials to physically attend the court, warning of potential arrest warrants if they failed to comply.

However, upon a plea from State Advocate General Kishore Datta, Justice Mantha allowed virtual presence for the two bureaucrats and the police officer, amending his earlier order. Earlier this month, the division bench of Calcutta HC Chief Justice TS Sivagnanam and Justice Hiranmay Bhattacharyya upheld Justice Mantha’s order for an NIA investigation in the case.
