Weeks after an Allahabad High Court judge faced backlash for stating that acts like grabbing a woman’s breasts or pulling the string of her pyjama don’t constitute rape or attempted rape, another judge from the same court has stirred controversy by granting bail to a rape accused, remarking that the victim had “invited trouble” and was “responsible” for the alleged incident.

According to the victim’s account, she had gone to a Delhi bar with three female friends, where they consumed alcohol and stayed until around 3 a.m. Heavily intoxicated, she claimed she accepted help from the accused, who insisted she accompany him to rest at his home. Instead of taking her to his house in Noida, he allegedly took her to a relative’s flat in Gurgaon, where he reportedly raped her twice. She also accused him of inappropriately touching her during the ride.

Justice Sanjay Kumar Singh, while granting bail, observed that even if the victim’s allegations were taken at face value, it could still be concluded that she had “invited trouble” and bore responsibility for what occurred. He also noted that the victim, being an MA student, was mature enough to understand the “morality and significance of her act” as mentioned in the FIR. The medical examination revealed a torn hymen, though the doctor refrained from confirming any sexual assault.

The accused sought bail on the grounds that, even assuming all allegations to be true, the case pointed more toward a consensual relationship rather than rape. His counsel also highlighted the fact that the accused had been in jail since December 2024, had no criminal history, and would not misuse his freedom if granted bail.

Considering the arguments and available evidence, Justice Singh concluded that a valid case for bail had been made and subsequently allowed the application.
