The US Supreme Court Has Agreed To Examine Trump’s Immunity Claim in The Election Subversion Case
The US Supreme Court has agreed to hear Donald Trump’s claim of immunity from prosecution for attempting to overturn his 2020 election loss, giving him a boost as he seeks to delay criminal proceedings while running for president again.

The justices halted Special Counsel Jack Smith’s criminal case. They will consider a lower court’s rejection of Trump’s claim of immunity from prosecution because he was president when he took moves to overturn President Joe Biden’s election victory over him.
The Supreme Court scheduled oral arguments for April 22 on a single question: “Whether and to what extent does a former president enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts while in office.”
Trump, the first former president to face criminal charges, is the leading candidate for the Republican nomination to face Democrat Joe Biden in the November 5 US presidential election.
The issue again brings the nation’s top judicial body, which has a 6-3 conservative majority and three justices selected by Trump, into the political fray. The Supreme Court is also expected to rule on whether to reverse a lower decision that blocked Trump from Colorado’s Republican primary ballot based on a constitutional provision governing insurrection.
On February 6, the United States Court of Appeals for the District of Columbia Circuit ruled 3-0 against Trump’s immunity claim, rejecting his bid for “unbounded authority to commit crimes that would neutralize the most fundamental check on executive power – the recognition and implementation of election results.”
United States Attorney General Merrick Garland appointed Smith in November 2022. In August 2023, Smith filed four federal criminal charges against Trump in the election subversion case. The March 4 trial date was postponed while Trump pressed his immunity claim, and no new date has been scheduled.
Trump has three additional criminal matters outstanding, including a trial in New York state court on hush money paid to a porn star scheduled to begin on March 25. Trump has pleaded not guilty in all of them, seeking to portray them as politically motivated.
In a tweet on social media, Trump praised the Supreme Court’s decision to hear his immunity claim.
“Without Presidential Immunity, a President will not be able to properly function or make decisions in the best interest of the United States of America,” Trump said in a tweet. “Presidents will always be troubled, and even paralyzed, by the possibility of unfair prosecution and vengeance after leaving office. This might result in the extortion and blackmail of a President.”
Representatives from the special counsel’s office did not immediately respond to requests for comment.
Smith’s allegations accused Trump of conspiring to defraud the United States, impeding legislative certification of Biden’s electoral victory, and plotting to do so, and conspiring to violate Americans’ right to vote.
Trump and his allies falsely claimed that the 2020 election had been stolen and developed a plot to utilize forged electors to prevent legislative certification of Biden’s win. Trump reportedly attempted to put pressure on then-Vice President Mike Pence to block certification. Trump supporters attacked the Capitol in an attempt to halt the certification.
If Trump reclaims the office, he may seek to utilize his powers to halt the prosecution or even pardon himself for any federal offenses.
ABOVE THE LAW
Last October, Trump attempted to have the charges dropped based on his immunity claim. Tanya Chutkan, a United States District Judge, denied the claim in December.
During January arguments in his appeal, one of Trump’s lawyers told the D.C. Circuit judges that even if a president sold pardons or military secrets or ordered a Navy commando unit to assassinate a political rival, he could not be criminally charged unless impeached and convicted in Congress.
In its decision to deny Trump’s immunity claim, the three-judge panel wrote: “We cannot accept that the office of the presidency places its former occupants above the law for all time after that.”
During arguments on Feb. 8, Supreme Court justices indicated skepticism towards a verdict by Colorado’s highest court that excluded Trump from the state’s Republican primary ballot, based on the U.S. Constitution’s 14th Amendment, after determining he engaged in an insurrection connected to the Capitol attack.
The Colorado and immunity cases thrust the Supreme Court into the election spotlight in the most direct manner since its 2000 decision, which effectively awarded the presidency to Republican George W. Bush over Democrat Al Gore.
In a second case to be heard on April 16, the Supreme Court has decided to rule on whether a guy involved in the Capitol incident can be charged with disrupting an official proceeding – the congressional certification of 2020 election results. Smith filed two obstruction-related charges in that case, which could have consequences for Trump.
