Supreme Court Upholds Madras High Court Decision to Reopen Graft Case Against Tamil Nadu Minister

In a significant legal development, the Supreme Court of India has declined to intervene in the recent order issued by the Madras High Court to reopen a corruption case against Tamil Nadu Minister K Ponmudy and his wife. The case involves allegations of irregularities in the transfer of the trial, and Justice N Anand Venkatesh of the Madras High Court made the decision to reopen it.
Chief Justice of India, DY Chandrachud, commended Justice Venkatesh’s ruling, emphasizing the importance of such judges in the judicial system. The case in question dates back to 2002 and revolves around allegations of disproportionate assets. In June 2023, Ponmudy and his wife were acquitted of these charges, but in August, Justice Venkatesh ordered the case’s reopening. Moreover, the judge initiated a review of legal proceedings against two other DMK ministers, Revenue Minister KKSSR Ramachandran and Finance Minister Thangam Thennarasu, in similar cases.
Ponmudy and his wife challenged the Madras High Court’s order in the Supreme Court, but the Supreme Court declined to entertain their petition. CJI Chandrachud pointed out that the matter was already pending before a single bench of the Madras High Court and advised the petitioners to argue their case before the High Court. The decision underscores the significance of the Madras High Court’s actions in pursuing accountability in cases of alleged corruption and irregularities.
