The Supreme Court has ruled that a woman in a long-term live-in relationship may not be able to accuse her partner of rape based on a false promise of marriage. According to a Times of India report, the court stated that if a couple has lived together for an extended period, it becomes difficult to establish whether sexual relations were solely based on such a promise.

The case involved a bank manager accused of rape by his live-in partner of 16 years, a lecturer, who claimed he had deceived her into the relationship under the pretext of marriage. However, a Supreme Court bench comprising Justices Vikram Nath and Sandeep Mehta dismissed the criminal charges, emphasising that both individuals were well-educated and engaged in a consensual relationship. The court noted that the couple continued their relationship even when posted in different towns, describing the situation as a “live-in relationship gone sour.”

The bench found it implausible that the woman remained in the relationship for nearly 16 years without raising concerns, suggesting that there was no element of coercion or deception. It further stated that the prolonged nature of the relationship weakened the credibility of the claim that sexual relations occurred solely due to a marriage promise. Even if such a promise was made, the woman’s decision to stay in the relationship for such a long time undermined her allegations, the court concluded.
