Supreme Court Halts Allahabad High Court’s Ruling on ‘Breast Grabbing Not Rape,’ Calls It ‘Insensitive’
The Supreme Court on Wednesday put a hold on the controversial Allahabad High Court order, stating that the judgment reflected a “lack of sensitivity.”

The Supreme Court on Wednesday put a stay on the Allahabad High Court’s controversial order, which stated that actions like grabbing breasts or pulling the string of pyjamas do not amount to an attempt to rape and that the prosecution must move beyond this “stage of preparation” to prove the rape charges. The apex court took up the matter suo motu after the group ‘We the Women of India’ approached it against the High Court’s March 17 ruling.
A bench of Justices B.R. Gavai and Augustine George Masih remarked that the judgment reflected a “total lack of sensitivity” from the High Court judge.
“We regret to note that it shows complete insensitivity on the part of the author of the judgment. It was not delivered impulsively but came four months after being reserved, indicating deliberate application of mind. Generally, we avoid granting a stay at this stage, but since the observations in paragraphs 21, 24, and 26 are contrary to the principles of law and display an inhuman approach, we stay those observations,” the court stated, as per Bar and Bench.
The Supreme Court also issued notices to the Centre and the Uttar Pradesh government, seeking their responses, and requested assistance from Solicitor General Tushar Mehta and Attorney General R. Venkataramani.
