Supreme Court Declines Intervention in Delhi Chief Secretary Tenure Extension Dispute

The Supreme Court dismissed the Delhi government’s plea challenging the Central government’s decision to extend the service tenure of the Delhi Chief Secretary. Chief Justice of India (CJI) DY Chandrachud clarified that the extension under rule 16 of the 1961 rules won’t be applicable to the chief secretary of GNCTD if their function encompasses the excluded subjects.

CJI Chandrachud emphasized that the decision to extend the incumbent chief secretary’s tenure for six months, in light of the CB 2 Judgment and subsequent services act, isn’t considered a violation of the law. He stated that the evaluation at this stage is preliminary, refraining from conclusive adjudication on the pending issues before the constitution bench.

The Delhi government’s plea contested any unilateral move by the Centre to appoint a new chief secretary or extend the tenure of the current official. The Central government, on Tuesday, had informed the apex court about its intent to prolong the tenure of Chief Secretary Naresh Kumar beyond November 30.

In a related development, the Supreme Court rebuked the Delhi government for not releasing funds for the Regional Rapid Transit System (RRTS) project to the National Capital Region Transport Corporation (NCRTC). Justice Kaul highlighted the delay and threatened to halt the government’s advertising budget, redirecting funds toward essential infrastructure projects if necessary. The court stressed the importance of prioritizing national projects over expenditure on advertising.

The recent courtroom exchanges have spotlighted the conflict between the Delhi government and the Centre, particularly concerning bureaucratic appointments and infrastructure development, marking a contentious chapter in their ongoing jurisdictional disputes.
