SC Extended Ashoka University Professor Ali Khan Mahmudabad’s Interim Bail Until 3rd Week of July

New Delhi: On Wednesday, the Supreme Court extended the interim bail of Ashoka University professor Ali Khan Mahmudabad until the third week of July. He was earlier arrested over allegedly objectionable social media posts related to Operation Sindoor.
However, the court refused to lift the gag order preventing him from speaking on matters related to the two FIRs under investigation. “We do not want him to provide a running commentary on the issues under probe,” the bench said.
Expressing concern over a potential broadening of the investigation, Mahmudabad’s legal counsel urged the court to keep the Special Investigation Team (SIT) focused strictly on the matters mentioned in the FIRs. Responding to this, the court advised the SIT not to overreach its mandate. “Why examine his devices unnecessarily? Stick to the scope of the FIRs,” the court remarked, instructing the SIT to stay within its assigned task. The next hearing is scheduled for the second week of July, and the SIT has been asked to submit a copy of its report after presenting it to the appropriate court.
Senior advocates Kapil Sibal and Sidharth Luthra, representing Mahmudabad, repeatedly appealed to the bench of Justices Surya Kant and Dipankar Datta to ease the restrictions, assuring that the professor would refrain from making any comments related to the FIRs. Sibal emphasized Mahmudabad’s maturity and education, noting that he understands the consequences of his past writings and urged the court to drop the restriction.
The bench remained firm, stating, “He must wait for some time. Bring this up again at the next hearing. The restriction only pertains to the content of the FIRs. We don’t want a parallel narrative to emerge.”
Haryana’s Additional Advocate General informed the court that a SIT, comprising senior IPS officers—ADGP Mamta Singh, SP (Karnal) Ganga Ram Punia, and SP (STF, Gurgaon) Vikrant Bhushan—was already formed and that the investigation was proceeding efficiently. The apex court directed the SIT to file its report with the jurisdictional court and submit a copy to the Supreme Court.
