Why Sanjay Roy wasn’t Sentenced to Death in RG Kar Rape-Murder Case?

Sanjay Roy, a former civil volunteer, was sentenced on Monday to life imprisonment until death for the rape and murder of a trainee doctor at Kolkata’s RG Kar Medical College and Hospital last year. The verdict sparked disappointment among many who had anticipated a death sentence for the crime, which had caused national outrage. Advocate Rehman explained the reasoning behind the Sealdah court’s decision, stating that the additional district and sessions judge, Anirban Das, ruled that the crime did not meet the criteria of the “rarest of the rare” cases required for the death penalty. Judge Das, who had found Roy guilty on Saturday of committing the crime on August 9 last year, ordered the convict to pay a ₹50,000 fine. The court also directed the state government to compensate the victim’s family with ₹17 lakh. While the CBI had sought capital punishment, the judge rejected their plea, noting that the case did not warrant such a sentence.
Under Section 66, the judge ruled that Roy would remain in prison for the rest of his life. Das further emphasised that since the victim died while performing her duties at her workplace, it was the state’s responsibility to provide compensation to her family. This included ₹10 lakh for her death and ₹7 lakh for the rape, reported PTI.
