Mr. Kejriwal Approaches the Supreme Court, Challenging his Arrest in the Liquor Policy Case

In its recent move, the AAP national convenor and Delhi’s chief minister, Arvind Kejriwal, appealed in the Supreme Court against the Delhi High Court order upholding his arrest by ED in the alleged excise policy scam case. The petition is likely to be heard by CJI DY Chandrachud today.
Arvind Kejriwal approached the apex court against the judgement passed by Justice Swarna Kanta Sharma of Delhi High Court yesterday, upholding his arrest, who was of the view that ED presented enough evidence to show Mr. Kejriwal’s involvement in the case.
“Material collected by ED reveals that Kejriwal conspired, was involved in the formulation of the excise policy, and used proceeds of crime. He is also allegedly involved in personal capacity in the formulation of policy and demanding kickbacks, and secondly, in the capacity of national convenor of the AAP,” observed the single judge bench of the Delhi High Court.
Arvind Kejriwal alleged that the decision to arrest him merely days before general elections is a deliberate move, and the Prevention of Money Laundering Act (PMLA) is being misused by the centre to create an uneven playing field for the BJP. He argued that summons issued by the Enforcement Directorate were vague in nature, and the centre is using the central agencies as a weapon to crush the opposition.
The ED, represented by Additional Solicitor General S.V. Raju, countered that Arvind Kejriwal’s arrest was based on meticulous collection of evidence and that the procedure of arrest was correctly followed. ED informed the High Court that Arvind Kejriwal was provided with the grounds of his arrest in writing.
Arvind Kejriwal, who was arrested by the ED in the case on March 21, and the later unfolding of the events in the case remanded him in judicial custody until April 15, 2024.
Other than Delhi chief minister Arvind Kejriwal, former deputy CM of Delhi Manish Sisodia and AAP MP Sanjay Singh were also arrested by the ED in the said case. While Manish Sisodia continues to remain in jail, Sanjay Singh was granted bail by the Supreme Court.
