A special court in Mumbai has acquitted all seven accused in the 2008 Malegaon blast case, citing that the prosecution failed to prove the allegations. The blast, which occurred on September 29, 2008, killed six people and injured over 100 in the communally tense town of Malegaon, located about 200 km from Mumbai.

The Accused

  • Pragya Singh Thakur: Former BJP MP from Bhopal
  • Lt. Col. Prasad Shrikant Purohit: Former army officer
  • Major (Retd.) Ramesh Upadhyay
  • Ajay Rahirkar
  • Sudhakar Dwivedi
  • Sudhakar Chaturvedi
  • Sameer Kulkarni

The Verdict
The court observed that terrorism has no religion but emphasized that conviction cannot be based on mere perception. The prosecution’s case relied heavily on circumstantial evidence, including the alleged use of a motorcycle owned by Pragya Thakur. However, the court found that the prosecution failed to establish a clear link between the accused and the crime.

Key Points from the Judgment

  • Lack of evidence: The court noted discrepancies in medical certificates and documentation related to the custody and treatment of some accused.
  • Benefit of doubt: The judge ruled that suspicion is not sufficient ground for conviction and that the benefit of the doubt must go to the accused.
  • Investigation flaws: The court highlighted manipulation in some instances and questioned the reliability of witness statements.

Reaction from the Accused
Pragya Thakur, reacting to the verdict, said that the case ruined her whole life and that “God will punish” those who are guilty. She claimed that she was arrested and tortured, and her life was ruined due to the false allegations.

The acquittal of all seven accused brings an end to a 17-year-long trial, marked by numerous twists and turns. The case was initially investigated by the Maharashtra Anti-Terrorism Squad (ATS) and later taken over by the National Investigation Agency (NIA) in 2011.
