Jammu & Kashmir Reservation and Reorganization (Amendment) Bills Passed in Lok Sabha

Union Minister Amit Shah presented the Jammu & Kashmir Reservation (Amendment) Bill and the Jammu & Kashmir Reorganization (Amendment) Bill and stressed the progress in the state after the abrogation of Article 370. The debate on both Bills continued for over 6 hours before they were finally passed in the Lok Sabha. The Home Minister stressed that the two bills concerning Jammu and Kashmir would provide the basic rights to the inhabitants from which they were deprived for many years. Mr. Shah emphasized that the state faced the negative consequences of the decisions of our first Prime Minister Jawaharlal Nehru that attracted the United Nations’ attention towards Kashmir.
The Jammu and Kashmir Reservation (Amendment) Bill, 2023, introduced in Lok Sabha in July, is a modification of the Jammu and Kashmir Reservation Act, 2004. The act ensures reservation in jobs and professional institutions for Scheduled Castes, Scheduled Tribes, and other socially and economically marginalized sections. The essential characteristics of the Bill consist of the socially and educationally backward classes, including the people inhabiting the areas near the Actual Line of Control and the International Border. The proposed bill substitutes the phrase “weak and underprivileged classes” for “other backward classes” as designated by the Union Territory of Jammu and Kashmir, thereby wiping out the definition of the weak and underprivileged classes.
The Jammu and Kashmir Reorganization Bill, 2023, is an amendment to the Jammu and Kashmir Reorganization Act, 2019. This Act mentions the reorganization of Jammu and Kashmir into the Union Territories of Jammu and Kashmir (with legislature) and Ladakh (without Legislature). The Bill increases the number of seats to 90, with seven seats reserved for Scheduled Castes and nine seats reserved for the Scheduled Tribes. It specifies the power of the Lieutenant Governor, who has the authority to appoint two individuals from the Kashmiri Migrant Community to the Assembly. Out of the appointed members, one must be a woman. The Migrant can be any member relocated from the Kashmir Valley after November 1, 1989, and must be registered with the Relief Commissioner.
The Home Minister has confirmed that plans and operations have been in force for the last three years to counter the terrorist incidents in Jammu and Kashmir, and soon the state will be free from violence. The state will be a peaceful and prosperous state in the years to come.
