International Court of Justice Says Israel Needs to Ensure Urgent Humanitarian Aid to Gaza

On March 28, the International Court of Justice issued an order directing Israel to implement measures ensuring urgent humanitarian aid, such as expanding access through land crossings, to alleviate severe shortages of essential resources like food, water, and fuel in the conflict-stricken territory of Gaza.

The court’s legally binding order instructed Israel to undertake “all necessary and effective measures” promptly and in full collaboration with the United Nations to guarantee the unrestricted provision of critically needed basic services and humanitarian aid, encompassing essentials such as food, water, fuel, and medical supplies. Furthermore, it mandated Israel to promptly ensure that its military refrains from engaging in actions that would violate the rights of Palestinians in Gaza, recognized as a protected group under the Convention on the Prevention and Punishment of the Crime of Genocide. This includes preventing, through any means, the obstruction of urgently required humanitarian assistance deliveries.

The court said in its order that “Palestinians in Gaza are no longer facing only a risk of famine, as noted in the Order of January 26, 2024, but that famine is setting in, with at least 31 people, including 27 children, having already died of malnutrition and dehydration according to the United Nations Office for the Coordination of Humanitarian Affairs.”

The International Court of Justice issued two new provisional measures in a case initiated by South Africa, alleging Israel’s involvement in acts of genocide during its military operations following the October 7 attacks by Hamas. Israel vehemently denies these allegations, asserting its military actions are acts of self-defense. The order followed South Africa’s request for additional provisional measures, including a ceasefire, citing the dire humanitarian situation in Gaza due to shortages leading to starvation, against which Israel urged the court not to issue any new directives.
