Court Sentenced a Woman to 10 Years of Rigorous Imprisonment for Sexual Assault on a 4-Year-Old

New Delhi: A Delhi Court recently sentenced a woman to 10 years of rigorous imprisonment for sexually assaulting a 4-year-old minor girl in 2016.
The court observed that the accused woman had committed penetrative sexual assault on the minor survivor by applying her mouth to the vaginal area. Convicting the accused, the court of additional sessions judge Kumar Rajat said that the act caused the minor and her parents ‘immense mental trauma’. The court sentenced her to 10 years of rigorous imprisonment with a fine of Rs. 16,000.
The court was hearing the case against Shashi, who was convicted of offenses under Section 6 (aggravated penetrative sexual assault) of the Prevention of Children from Sexual Offenses (POCSO) Act, and Section 354 (assault or criminal force to woman with intent to outrage her modesty) of the Indian Penal Code.
Along with noting the nature of the offense, the court also took note of mitigating circumstances such as the poor socio-economic background of the convict who is the sole bread earner of the family and has no property. The court said that the convict would only be sentenced under Section 6 of the POCSO Act, considering its higher degree of offense compared to the section in IPC.
The court on the case stated that there was no definite formula for imposing a sentence and that it has been contingent on the facts and circumstances in each case, the nature of the crime, how it was planned and executed, its motive, the conduct of the convict, and all other attending circumstances. “The object and basic purpose of sentencing is that the offender doesn’t go unpunished and justice is done to victims of crime and society,” the court added.
