A civil court in Punjab has refused to issue an interim order to block the screening of a BBC documentary on the murder of popular Punjabi singer Sidhu Moose Wala. The documentary, titled “The Killing Call,” was released on YouTube despite a legal challenge from Moose Wala’s father, Balkaur Singh.
Background
Balkaur Singh had filed a civil suit against the BBC and two individuals, Ishleen Kaur and Ankur Jain, alleging that the documentary’s release could impact the ongoing criminal trial into his son’s murder and violate the family’s right to privacy. Singh’s lawyer argued that the documentary used Moose Wala’s name, likeness, and life story without obtaining consent from the family.
Documentary Details
The two-part documentary explores Moose Wala’s life, rise to fame, and the circumstances surrounding his assassination on May 29, 2022. The film features interviews with Moose Wala’s friends, journalists, and police officials from Punjab and Delhi, as well as an audio interview with Canada-based gangster Goldy Brar, who claimed responsibility for the murder.
Court’s Decision
Civil Judge Rajinder Singh Nagpal declined to issue an interim order to block the documentary, scheduling the matter for a detailed hearing on June 12. This decision allows the documentary to remain available on YouTube, despite Singh’s objections.
Reaction from the Family
Balkaur Singh had filed complaints with the Maharashtra Police and sought a ban on the documentary’s screening, alleging that it could tarnish his son’s legacy. However, the police have not yet taken any action on the complaints.
The court’s decision will be closely watched, as it raises questions about the balance between freedom of expression and the right to privacy.
