On Wednesday, a Public Interest Litigation (PIL) was filed in the top court, which sought the formulation of an expert committee to examine the side effects and risk factors associated with the Covishield vaccine.
The PIL filed by Advocate Vishal Tiwari urged that the committee should include medical experts from the All India Institute of Medical Sciences (AIIMS) and a retired Supreme Court judge. The PIL further sought directions to establish a ‘vaccine damage payment system’ for citizens who are severely disabled and are facing health complications as a result of the vaccination drive during COVID-19. In addition, the PIL adds that people and/or families should be compensated for being severely disabled or who died after taking the Covishield vaccine dose.
The vaccine controversy that reached the Supreme Court of India erupted when UK-based AstraZeneca, a pharmaceutical giant, admitted that its Covid vaccine could cause a blood clotting side effect in’very rare cases’. According to media reports, AstraZeneca in the London High Court admitted that the vaccine developed by Oxford could cause thrombosis with thrombocytopenia syndrome (TTS) in’very rare cases’.
The same vaccine in India was manufactured by the Serum Institute of India (SII) and was named Covishield.
The filed PIL claims that more than 175 crore doses of Covishield were administered to the masses.
According to reports, the Union government had informed the top court that vaccines manufactured by third parties had successfully undergone regulatory review, and it may not be legally sustainable to hold the state directly liable to provide compensation.
