CJI Lauds New Criminal Laws, Says India Set for Major Overhaul

Heralding the new criminal laws as a monumental moment, he said India is set for a significant overhaul of its Criminal Justice System.

The Chief Justice of India (CJI) D Y Chandrachud, speaking at a conference on ‘India’s Progressive Path in the Administration of Criminal Justice System,’ lauded the enactment of new criminal justice laws as a watershed moment for society. Heralding the new criminal laws as a monumental moment, he said India is set for a significant overhaul of its Criminal Justice System. He stressed the effective implementation of these laws by those in power.

The Chief Justice said that the enacted laws are a sign of transforming the Indian legal framework concerning criminal justice. He stressed the addition of reforms that would safeguard the rights of victims.

“The enactment of these laws by Parliament underscores India’s evolving dynamics and the pressing need for innovative legal mechanisms to address contemporary challenges,” he was noted saying.

The CJI, in his speech, spoke about the challenges posed by technological advancements in crime and highlighted the need for the criminal justice system to adapt.

“The growing influence of technology and the emergence of new-age crimes leveraging digital platforms present investigative challenges, evidence admission issues, and complexities in justice delivery,” CJI D Y Chandrachud said.

CJI also appreciated the new laws that would pave the way for modernizing India’s legal framework and introducing much-needed improvement to protect victims’ interests and enhance the investigation and prosecution of offenses.

He also stressed the importance of safeguarding privacy rights amidst the digitization of legal proceedings and the creation of digital evidence, emphasizing the need for healthy systems to prevent data breaches.

The Chief Justice of India was upbeat that the implementation of these new laws would highlight areas of improvement, guided by a justice-oriented approach that would balance the interests of victims and the accused.

The conference, organized by the Union Ministry of Law and Justice, was attended by Union Law Minister Arjun Ram Meghwal, Attorney General R Venkataramani, and Solicitor General of India Tushar Mehta.

The three new criminal laws – Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita, Bharatiya Sakshya Act – which are heralded as a comprehensive overhaul of India’s criminal justice system, will come into effect from July 1. However, the provision related to hit and run cases by vehicle drivers will not be enforced immediately.

These new criminal laws were passed by Parliament last year on December 21 and received the President’s assent on December 25.
