Citizenship Amendment Act Rules Notified, Four Years After the Law was Passed

Just before the general elections announcement, on March 11, the Ministry of Home Affairs (MHA) put out new rules called the Citizenship Amendment Rules, 2024. These rules will let the government use the Citizenship Amendment Act (CAA), which was passed by Parliament in 2019.

The CAA helps people who don’t have the right papers but are from Hindu, Sikh, Buddhist, Parsi, Christian, or Jain communities from Pakistan, Bangladesh, and Afghanistan to get Indian citizenship. However, they need to provide six kinds of documents and specify the date when they came to India.

The law was passed on December 11, 2019, and the President approved it the next day. The MHA said it would start on January 10, 2020, but because the rules weren’t ready, it couldn’t start.

Amit Shah, the Union Home Minister, said on X that these new rules would let people from minority groups in Pakistan, Bangladesh, and Afghanistan get Indian citizenship. He said this fulfilled a promise to these communities.

To apply, people need to register on a website and use a mobile app called CAA-2019. They have to upload all their documents, and the government will check them. There’s also a committee that will review all the applications. People applying have to prove when they came to India and that they’re part of one of the eligible communities. They also need to provide proof about their parents’ birth dates and swear an oath of allegiance in front of a committee. If they don’t do this, they might not get citizenship.

The law doesn’t apply to some parts of the northeast and certain tribal areas. The Home Ministry had to ask for many extensions to make these rules.
