Apex Court to Hear Arvind Kejriwal’s Plea Against ED Arrest on Monday

The Supreme Court is all set to hear the plea filed by Arvind Kejriwal challenging Delhi High Court’s order upholding his arrest by ED in the alleged Excise policy scam on Monday, i.e., April 15, 2024.

The Special Leave Petition filed by jailed Delhi CM Arvind Kejriwal on April 10, 2024, has been listed for hearing before the bench of Justice Sanjiv Khanna and Justice Dipankar Datta.

The Delhi High Court’s single-judge bench of Justice Swarna Kanta Sharma on April 10 produced her judgment upholding Kejriwal’s arrest in the Excise Policy Scam by the Enforcement Directorate. The court observed that the Enforcement Directorate was able to produce enough material in front of the bench, including statements of an approver and AAP’s own candidate, stating Kejriwal’s involvement in the case.

“Material collected by ED reveals that Kejriwal conspired, was involved in the formulation of excise policy, and used proceeds of crime. He is also alleged to be involved in the personal capacity in the formulation of the policy and demanding kickbacks and secondly in the capacity of National convenor of AAP,” Justice Swarna Kanta Sharma stated.

The bench further said that the money received as kickbacks was used for political campaigning in the 2022 Goa assembly elections.

Arvind Kejriwal, in his statements, claimed that his arrest by ED just days before the general elections is a deliberate move by the Centre. He also argued that the Prevention Of Money Laundering Act (PMLA) is being misused by the government. He stressed that the summons issued by ED were vague in nature.

The ED, however, countered that Arvind Kejriwal’s arrest was based on meticulous collection of evidence and he was also furnished with his arrest in writing.

Mr. Kejriwal was arrested on March 21, 2024, and is in judicial custody.
