3 Acquitted in Riots Case Get the Benefit of Doubt by Court

New Delhi: The Delhi High Court acquitted 3 people accused of rioting, arson, and other offenses in a case related to the 2020 Delhi riots. The 3 people were granted the benefit of doubt by the court and released.

The court, consisting of the additional sessions judge Pulastya Pramachala, gave them the benefit of doubt as their presence at the place of the incident had not been established. “I find that the charges leveled against all three accused persons in this case are not proved beyond reasonable doubt. Hence, accused persons are acquitted of the charges in connection with the incident at the shop,” commented the judge.

The court was hearing a case against the three accused – Akram, Mohammad Furkaan, and Mohammad Irshad – who were accused of being a part of the riotous mob that lit a bookshop near Shiv Vihar Tiraha on Feb 24, 2020. The Dayalpur police station had filed a charge sheet in connection with this case against the accused people.

In the 34-page judgment dated January 23, the court discredited the testimonies of two police witnesses and stated that it was not safe to rely on the testimonials to assume the presence of the accused in the mob, thus acquitting the three of the case. The court further added that though there is reliable evidence to prove the vandalism and arson by the riotous mob, there are certain inconsistencies in the statements of the two constables. Neither of the duos made any statement or daily diary entry of having identified the accused persons immediately after the incident, it added.

While both constables identified the accused persons after seeing a video clip on March 6, 2020, there was no clarity about the specific video clip being seen. Also, the constables didn’t lead the investigating officer.
